A Major Change: Paid Family & Domestic Violence Leave
From 1 February 2023, a major change took place in relation to entitlements for some employees. Now, employees of non-small business employers – that is, employers with 15 or more employees – are able to access 10 days of paid family and domestic violence leave. Importantly, the changes also apply to those with part-time and casual positions.
For those employers with less than 15 employees, their employees are able to access this new entitlement from 1 August 2023. Up until that time, leave required for those purposes remains as unpaid leave.
The changes are a minimum leave entitlement and come from the National Employment Standards. Notably, they increase the previous entitlement from 5 days to 10 days. The entitlement is available immediately, meaning that from the day an employee commences in a position their paid leave entitlement is available. It will then re-set on the anniversary of the employee’s work and does not accumulate year on year.
